Trump denied immunity in election interference case
On Tuesday, a federal appeals court dismissed Donald Trump’s claim of immunity from criminal prosecution over allegations of plotting to overturn the 2020 election results.
“We cannot accept former President Trump’s claim that a President has unbounded authority to commit crimes that would neutralize the most fundamental check on executive power,” the unsigned but unanimous opinion from the three-judge panel said.
The court declined to support an expansive interpretation of executive power, emphasising that Trump’s actions while president did not shield him from legal accountability for his alleged involvement.
The opinion said, “former President Trump’s stance would collapse our system of separated powers by placing the President beyond the reach of all three Branches. We cannot accept that the office of the Presidency places its former occupants above the law for all time thereafter.”
Trump submitted a motion to dismiss the federal election interference case filed by special counsel Jack Smith last year. The charges against the former president included attempts to overturn his 2020 election loss, which allegedly involved promoting false electors and obstructing Congress on January 6, 2021.
